The mother of my son is making it difficult for me to have contact with him.
My son is 1 year and 3months, I also have another son which is 7months with another female. Now my problem is that I wish to be on my sons birth certificate but the mother of my first child refuse's to put me on it? I take responsibility for my children an have been involved from day 1, I have now received a letter from my first child's mother stating conditions she wishes for me to agree to. What can I do because I do not want to agree to her terms until I have some of my request met, which is to put my name on my sons birth certificate and to stop her from threatening me that she will stop me from seeing my son. And once I have been taking care of child am I entitled to be on his birth certificate?
What rights do I not have due to not being on my child's birth certificate?

Take her to court and request paternity. Once you are determined to be the father, your name will be added to the B/C regardless of what she wants. You will also be allowed to request visitation, which she cannot decide not to let you take.

Ignore her letter. It is worthless. This is a legal matter... let the courts handle it.

Would it cost me to take her to court and if so do you know how it could possibly set me back as I am in full time emplotment and also have another child to support?

It depends on where you live. Maybe a few hundred, possibly less. And court fees are a sliding scale, generally, so if filing causes a hardship you may be able to get the fees waived. Call the court and ask them... that's the best bet.

Thank for your advise, I live in the uk, east london to be exact. Is the law different from what it is in the states?

Not as far as I have ever read, but a local barrister should be able to give you some specifics. I am not sure about court fees in the UK either. But generally the process is the same, although there might be details that are a bit different.

I know a few of our senior members are familiar with UK law... hopefully one of them will be along and be able to weigh in with a few more specifics.

Do you how long the process takes to get a court date to initially get the ball rolling? I do want to take the mother of my child to court but need to know what I actually need to do so I can represent myself?

Im sorry, but I don't. In the states it varies from city to city, so even making a guess would be just that. In the states it runs from a few days to a few months.

Have you tried calling or visiting the court and asking them the process? In many courts there is someone who's job it is to answer this kind of question and facilitate the process for those without legal representation.

If nothing else, a court clerk should at least be able to give you a timeframe and a cost.
