    My sons father has been seeing our son again since February.. my son stays with him every other weekend he's 6... and all of a sudden he filed a motion stating he wants our son every weekend and to decrease his child support... will court grant this what should I do... I work my but off and during the week of course I work and get home by 5 then is doing homework and dinner but really I enjoy my family time on weekends... and he states he's unemployed he can see him one day during the week and every other weekend... but every weekend is ridiculous where's mom and son time then... craziness... advice please

    He has a right to go to court and request whatever he wants. He might even be able to get 50% (joint custody) but ultimately it is up to the court to decide. A change in support is unlikely if there are no changes in income to justify it. If he had more income when the amount was set he may be able to get the support modified.

    So basically yes, he has a chance. Although since its only been a month or two, chances are the judge will not modify the visitation. Have you gotten notification from the court about the change? Most places won't even allow a hearing so quickly after something is set.
