Hello j:
Sounds like it to me. She should shop around for a lawyer. If she finds one who will take the case on a contingency basis (which means that it won't cost her a penny unless she wins), then she absolutely should sue the pants off the nurse, the clinic, the hospital and the doctor.

That would depend on what the standard of the medical profession is concerning such a mistake. You would need a member of the medical profession to issue an affidavit of merit stating that such an error constituted negligence and that the hospital should have dismissed the nurse as a result. There's also the question of real damages ; how much has your mother suffered and how much financial loss did your family sustain because of this error? All of these factors have to be considered in determining whether your mother has a case.
What are the circumstances surrounding the air getting into the line? Did the nurse hook it up wrong or was the equipment defective?
Oops, should have checked the original posting date on this one *lol*
