Okay MyEx husband.. has my son with him since 2006. I did give written permission for him to vist till augs of 2006.. I have tried to get him back and he has tried to come back since then I have learned that my ex husband who married a american has gotten my son a green card... I did not sign and papers to this nor was I sent any legal docments to sings we have joint custody of my son as I am primary caregiver , he did this when my son was under age, with out my concentand he has also not paid child surpoort in 5 years.. I was told in the past this was a custody case.. but was recently told that it is a matter of fraud and forgery as I never signed anything... where would I report this and to whom, one to get my son back and to to have him arreested for signing my name on legal docments...

Still important, where do you live? You say he got your son a US green card so he lives in USA?

If you have joint legal custody I think he would have the right to do legal papers in the sons name... however this is more a matter of child custody than immigration and I don't know a lot about child custody laws.

I would take this to family court, since he has joint legal custody he can file legal documents for the child with just his signature... so technically I think this means he is allowed to apply for a green card to enter the US.

However I don't think he has the right to take the child INTO the US without your consent also.
