I have an elderly client in a nursing home with a house to sell. His daughter (who has power of attorney) asked me to list the house. The elderly man's name as well as those of his 3 children are on the deed. Do all of their names need to be on the listing agreement? Do they all need to sign all docs? Do all need to be present at closing?

The listing agreement and all closing docs should be signed by all owners. However if his daughter has power of attorney then she can sign on her father's behalf.

If all of the closing docs have been pre-signed and pre-approved by the closing agent then it shouldn't be necessary to have all of them at the closing.

Thanks for the answer. I am not clear on how they are all listed on the deed but I assume you are either part owner or you are not. What I guess I am asking is is it possible for the children to be listed on the deed in some other role besides "owner"?

The only time I've seen people listed on deeds as anything other than an owner was when they were the executor or administrator of an estate. If that's the case here then they would still need to sign the listing agreement and closing docs.
