    Hi,

    I am from India. Worked in the US(Illinois) from Jan 2008 to May 2008 on an L1B visa.

    I returned to India and got married in May and haven't gone back to US. My wife never entered the US, but as of Dec 31st 2008 I have to set my status as Married.

    I tried Married filing jointly, but it was complicated with declaration of world income and more forms, so I tried Married filing separately, but it took my wife as a "personal exemption". Both Jointly and Separately seems to require that my wife also have a Social Security Number...

    I don't know how it's possible for me to get an SSN for my wife who never went to the US, and even I am in India now.

    Please let me know how I should file my taxes properly for maximum returns. Thank you..

    If you were in the U.S. from Jan 08 to May 08 (and not in 2007), then you will file nonresident tax return. You can not file joint return. You will report only your U.S. income on the tax return.

    Yes, I did not enter the US prior to 2008.

    Does this mean that I have to file using "1040NR-EZ" ?

    Can this be done online? Could you please guide me with the steps necessary..

    Also, what is the last date for filing?

    File Form 1040NR or 1040NR-EZ. Due date is April 15, 2009. Must be paper return. Mail to Department of Treasury, Internal Revenue Service Center, Austin, TX 73301-0215 USA

    Hi again,

    I am filling the form 1040NR-EZ... but I noticed that in my W2 form, there is a section called W-4 profile. It has my "Taxable Marital Status" as Single...

    FEDERAL: 2
    STATE: 0

    Does this mean that more tax was deducted at source from me because I was single..

    Whereas I got married after my return to India... and now I would like to file the 1040NR-EZ as "Married nonresident alien" as "Filing Status".

    Kindly advise how I should go about this.. thanks

    Another question is...

    What about the Social Security Tax and the Medicare tax withheld amounts in the W2? Are they not included anywhere while filing the 1040NR-EZ?

    No you do not report SS tax and Medicare tax on the tax return.
