I have been recently charged with criminal tresspassing on second degree. I'm 17 years old have never been arressted before. I was on my friend roof top but couldent remember what was his apt. number and was also caught with 6 member that was on top the roof that I some what know. We all attend the same school what is my worst case sceneario. I also have no lawyer but not looking for one. Just need some heads up my court date is on the 26 of march New York

It is the issue, that by court you better know the name of that friend, what apartment, and have him there to testify he was there in the house.

Beyond that have a good reason to be on the roof, beyond trying to break into one of the other apartments.

See if your friend can vouch for you being on the roof and hopefully you can get the charge dismissed.You might be able to get legal aid,you can explain your side quickly to them.If convicted you probably will get a fine plus probation of some sort. This charge now is a class A misdemeanor.

There probably just going to want to plead you out and be done w. it.If your able to get the charge dismissed press for that.They could offer you a acd or youthful offender.Those are one shot deals most of time,if you get charged again,you can't use them. Not that you want to,you never know what can happen. If you can't get the case dismissed for some reason,then ask about a diversion probably called an acd or lowering the charge down to simple trespassing which is a violation. With computer,internet,etc these days,it best to get the charge dismissed.In case an employer see the arrest you can explain to them,it was a misunderstanding and the charge was dismissed.

If your friend comes to court and says you're visiting him - 9 times out of 10 with no record, your case will be dismissed... because if your friend is there to vouch for you, you're not trespassing. Unless the roof says "no trespassing" or something like that on it. If you're not supposed to be on the roof it doesn't matter who you know in the building. You can try to get a violation for this... or if you're 17 you can get a Youthful Offender adjudication (YO). YO means your case is sealed. A violation is not a crime. But my best advice is to get a lawyer. If you can't afford one, perhaps legal aid is an option
