    Hi All,

    Wondering if anyone might be able to provide a little insight on this situation...

    While my ex and I were together, I had a credit card and added him as a user to the account (but the card was under my name). The day after we broke up, he goes and charges thousands to my card before I got the chance to take him off the card. He agreed to pay it back, but has been paying very slowly and has just decided today that he feels that he's paid enough and will no longer continue paying his debt (appx. $3,000).

    I'm wondering if I can bring him to small claims court over this? Technically he was listed as a user on my card when he made those charges.

    You can try, you will need to prove

    1. he charged the items
    2. exact cost of the items he charged and that they were for him alone
    3. you were broke up
    4. And if you can get him to state or prove he agreed to pay ( copies of checks he has been giving you and so on.

    But it is always worth a try, the worst, you lose, but you are not getting the money anyway

    Yes, take him to court. It is in his name also, his responsibility to pay for those charges he makes.

    Thanks so much for the advice! I have those 4 items... mostly in the form of Emails. Is Email permissible in small claims court?

    Normally yes, now if you tried that one me, I would object try to make you prove it was not altered and so on, but I doubt they will be smart enough to think of ways to fight you.

    Unless they come here and ask how to fight certain evidence.

    I don't read that the card was in his name. I read that the card was in HER name, with him as an additional signer.

    Yes, take him to Small Claims with the info already requested/advised.
