    Working on OPT, but H1 approved
    I am on F1 visa OPT, my H1 got approved since Oct 2008 but still I am working on OPT, as I need to get the stamping at the specified US consulate before I can enter the country back on H1.

    I am in the United States on F1 visa till now for these many days:
    2006 – 158days
    2007 – 365days
    2008 – 366days

    I have the following questions:
    1) Do I need to file 1040 or 1040NR-EZ?
    2) I have relocation expenses of $3500 reimbursed by my company and mentioned in W2, I will work at the present location for more than 38 months; can I claim this as exemption on either of the above forms?
    3) Since I am on OPT (student visa) from India can I claim any other exempts under special treaty? (apart from $5450 (line 11 of 1040NR-EZ) and $3500 (line 13) )

    1. If you are single, you file 1040NR-EZ.
    2. Yes, you can claim moving expenses. Read: Your U.S. Tax Return: Moving Expenses
    3. No, except moving expenses, student loan interest.
