    Parental rights in North Carolina
    Does anyone know where I can find out what it takes to get my ex husband to relinquish his parental rights to our 2yr old daughter. He hasn't seen her since June 2008 and doesn't pay child support. I don't want my daughter to ever see him if he doesn't want to take any interest in her.

    It is impossible to force someone to relinquish rights. He could consent to it if you have someone else willing to adopt (support) your daughter. Even if you manage to strip him of his rights because he is unfit - which I do not see here - he is still responsible for supporting her.

    When was the last time you were in Court to enforce child support?

    Thank you for responding. He doesn't make an effort to show up for court. How can I make him support her if he won't show up for court?

    You get a Court Order and you demand that he be held in contempt and the Order be enforced. It's not easy but it can be done - and it is done all the time.

    You have to first file for child support. Check the under the "county" section in your phone book because it's set up based on county. There's a form with basic info that you have to fill out. Then you will be assigned a caseworker who will work on getting him served the notice to appear. Once he has been served, the judge can make a order against him even if he doesn't show up on the court date. They will then send him a letter notifying him of the judgement and what he will be ordered to pay and how to go about making the payments. If he still doesn't cooperate, they will garnish it from his paycheck. They can make him pay arrears starting at the date that you first filed. It may take a while but isn't your daughter worth it?
