    Account levied because father's name on it.
    I am a 21 year old college student. I just went to check my balance on my checking account and all my money was gone. It says TAX LEVY and then a negative amount for all my money. My father has had several problems with the IRS, but I never expected them to seize my account. My account reads My Name OR My Dad's Name. Is there ANY WAY I can reclaim my money? My salary is automatically drafted into my account, and my dad has never withdrew or put money into the account. His name was on it from when he went with me to create the account when I was still in high school. Any help would be greatly appriciated because, frankly, without that account I don't know what I will do.

    Welcome to AMHD. I was able to locate this paragraph from page 8: "If we place a levy on your bank account, the levy attaches deposits that have cleared and funds that are available for withdrawal when the levy is received, up to the amount of the levy. The bank must wait until 21 days after a levy is received before sending the money. The holding period allows you time to resolve any dispute about account ownership. After 21 days, the bank must send the money, plus, if applicable, any interest earned on that amount." http://www.irs.gov/pub/irs-pdf/p594.pdf
    I would call my congressman first thing in the morning, and do whatever I could to have my automatic deposit halted; and find another bank until this mess is cleaned up.

    Thank you! I took your advice and opened a new account at a different bank, and I was able to stop my automatic deposit. I contacted the IRS this morning, and a women in collections told me that if I fax them a statement from my bank stating that my father has not used or accessed my account, they might remove the levy. So, I'm about to go fax that and keep my fingers crossed! Thank you again, very helpful advice

    Hi,

    There may be two chances:-

    1. Minors account until 18 years of age is always operated by his/her guardian/parents. So as you were minor, your fathers name is attached with your name.

    2. You & your father may have a joint Bank account.

    Louie, you really should start a new thread with this new question.

    What are the details? Is this a joint account as was that of the original poster in this thread? Has there been a levy made against the account? If so, is the levy for your debt?
