Bankruptcy and Repossession of a Mobile Home
Both my brother and I have mobile homes. We are both filing bankruptcy. I have not filed yet, but he already retained a lawyer. I got evicted already from mine and he is in evictions as well. But I am staying here at his mobile home for right now. The bank sent a certified letter to both of us that said they were going to take the home w/in 21 days. With my home the 21 days were not up yet and they changed the locks. Can they legally do that? I am still living here at my brothers w/ all of my possessions. I had heard that they can't repo the house if you filed bankruptcy. My brother has to call his lawyer tomorrow, but in the mean time I am walking on pins and needles waiting for them to change the locks on his w/ all my stuff in it. I also have 2 cats and a fish tank. Any input would be great! Thanks!

Since you have already arranged for legal advice, be patient. Get a cup of tea, a beer, or whatever relaxes you and wait until tomorrow for a professional opinion.

When did you file for bankruptcy, it takes a little time from the time you file at the court house, ( not just hire the attorney) till they are notified.

Next the with/in does not mean they wait, it means that sometimes before 21 days, and changing the lock on a mobile home is different than that of a house. A house is foreclosed, a mobile home is repo'ed like a car, and the changing of the lock is the first step in repo.

And you are filing bankrutpcy, and letting the mobie home go into it anyway, so it really should not matter.

You should relax and sit back take your mind off it and just go to the library and look on the computer and get a job that will definitely help trust me
