On march 29th of 2007,icame home from work at 2:30pm on anice sunny day.I picked up a6 pack of beer and was going to fix aproblem with my well.I'm a plumber.I came in the house and could not find the keys to my garage,so I asked the girl that was living with me at the time where they were,she had a habit of hidding my keys.I should say that we were not what you would call a couple ,but we did share the same bed at times.Anywayswe got into an argument during which my throat was cut with a plastic bottle opener,not life threatening but bad enough that it required medical attention.I went to the bathroom to look at my neck.When I returned she had called 911for anAMBULANCE!! I was not happy about this because I have a history with 3 local cops.Anyway when the parametics arrived so did the o.p.p.Icame out of my house wearing only a pair of jeans.there were 3 officers on my property.I knew one of the female cops she said Paul get in the ambulance.Ibegan walking to the amblance ipassed the first cop who was about 18 ft away when said drop the weapon.[i was carrying the red plastic beer opener]istopped and told him to off it was only a beer opener.Why I did not drop it to this day is amystery.the female told me again to get in the ambulance,I moved forward and againheard the other officer say drop the weapon,I turned and once a told him it was a beer opener,he then withdrew pepper spray and sprayed me from the distance of18 ft.Once I could not see itried looking in his direction I remember seeing briefly a hand gun in his hand.Then I heard the sound of the gun going off.idon't remember hearing the 2nd shot.Isuffered acollased right lung and my liver was split in 2.I was air lifed to sunnybrook hospital in toronto,where they saved my life.Iwas charged with attempt murder of acop amongst other lesser charges.After 16 months in prison the charges where dropped fofr every thing accept I plead guilty to assult with a weapon even though I never assulted anyone.It was a plea bargin I just wanted to get out of jail.Turns out the 2 paramedics stated to the cops and crown attorney,that the closest igot to any cop was 18 to 20 ft.They basically got me out of jail due to there statements.No other cop on the scene drew a weapon or pepper spray and I learned that the cop that shot me was a rookie of only 11months.Are you starting to see the picture the guy thinks a cowboy he was 32 yrs of age.Now to my long awaited question do I have chance of suing the cop and the o.p.p asciation.Ican know longer work,I've been diagnosed with P.T.S D.this is bull.Yes I do have a crininal record for assults.Thats the short form.PLEASE help.Thank you for any advice.Paul Reeve

Let me see that "beer opener was so important to you that you did not drop it when ordered, and even having being maced you still did not drop the opener.

So a officer sees something shiny in your hand, and at 20 feet may not tell it from a small knife.

Yep I would not have shot you, but after I maced you I would have used my ASP and beat you, but then that is just me ( a lot less paper work than if you use your weapon)

But I would have called it a good shooting, and said that if they ordered you to drop what you have in your hand today, you would not curse them but would drop it.

And if it was believed to be a knife, if you were within that 20 feet that is an allowed distance to shoot the subject.

So my opinion, you should have droped the stupid thing and none of this would have happened.
