    I have H4 visa, wants to apply for H1B visa
    I am in USA with my husband having H1b visa and I have dependent visa i.e H4 visa, I want to apply for my H1B visa. I want to know about the procedure to apply.

    You need to have a petitioner file for your H-1B. Position must require a bachelors degree and you must have that degree. Should file change of status on form I-129 with H supplement on or about April 1, 2009, for a October 1, 2009 job start date.

    The I-797 approval notice will have your new I-94 at the bottom to show your new nonimmigrant visa status, H-1B. Good luck!

    Also, remember that your time as an H-4 no longer counts towards the 6 year max. there is a new memo from USCIS clarifying this point.
