Hi,

I have a house in Chennai, India which I have rented out to a tenant. Now the lease has expired for almost 5 months and the tenant refuses to vacate the house. Instead, he is threatening my family of his having political contacts.

Please advice me how can I get this tenant to vacate my house. If I want to move the court to order him vacate my house, how much time will this procedure take and what is the process behind it? How are the court proceedings for cases like this in India?

I hope someone around here might know about specific legal procedures in India but if he has been living there without a lease in general (in Canada and USA) the lease would be assumed to be month to month and you would have to give only 30 days notice and if he does not leave than it's time to involve the court.

Do they continue to pay rent these last 5 months?
