    Guardianship of my granddaughter
    I have a 6 month old granddaughter and my son is going to court for full custody and shortly after he gets custody he will be going away to the military for a long while and leaving her with me.
    My question, when he is awarded full custody and he leaves me as guardian, what rights do I have against the non custodial parent?
    My second question, there are forms on the internet that you can be downloaded and filled out for guardianship, do they have to be filed with the courts?

    Someone please advise!

    Guardianship is awarded by a court otherwise it doesn't exist. Unless your son gets full legal and physcial custody and the NCP gets nothing, then he may not have the option of leaving the child with you.

    The NCP may successfully petition the court for temporary custody until his return. She would certainly have first preference over grandparents unless there is an issue of unfitness.

    Does your son have an attorney? He really needfs to run this by his attorney.
