    Resident or Non Resident - H-1B
    Hi,

    Since October 2006 I worked under an OPT for a company in NYC, then I went to France for a couple days in Oct. 2007 and came back with an H-1B and kept working for the same company until now.
    Last year I filled my taxes as a non-resident, now that it has been over a full year that I have been on my H-1B, am I suppose to fill in my federal taxes as a resident?
    Or still as a non-resident?
    What about the state taxes?

    For 2008, you will file resident tax return.
