    Which Form Should I submit for F1 visa?
    Hi,

    I am currently working under OPT F1 visa status. I worked 4 months in 2008 under same visa status.

    Which form/s do I need to send to IRS?

    On F1/OPT you are exempt from residency for 5-years. You must file non-resident tax return Form 1040NR or 1040NR-EZ and Form 8843. Your income is not subject to FICA taxes but you must pay federal and state income taxes.

    On your OPT income you will get deduction based on tax treaty between the U.S. and your country.

    I also found out that for Students under US-India Tax treaty , I can claim $5450 standard exemption under Article 21(2) . IS this true?

    Yes, you can claim $5,450 as itemized deduction. You can not claim any other itemized deduction.
