I have a outstanding debt with the 407 ETR in Ontario Canada and I was wondering what is the Statue of Limitations on this debt.

The orignal debt was from 2000 owing $450.00. They are now claiming I owe them $2400.

I placed a phone call to the 407 and was informed that they do not follow the Statue of Limitations law.

I live in Ontario but don't use the 407 (a toll road for those who don't know. A transponder is used to keep track of fees).

It is beyond my compehension that someone wouldn't pay their monthly billing for the 407. It is pretty reasonable and does reduce travelling time. My son has a transponder, my husband does, because both need to access the 407ETR. They have no trouble paying the fees and no one around here is excessively well off. I don't know how the fine got up that high unless service charges are tacked on to the unpaid bill.

No, it is considered a traffic issue, therefore no statute of limitations. Eventually you won't be able to get a new sticker for your licence plate (or renew your ownership) because the fine will show up at the DMV when you need one, so it will either be pay up or don't get a sticker or your ownership, therefore I guess you don't drive, or incur bigger fines if you are caught with an outdated license plate.

The statue of limitations only applies to the ability to enforce the debt via the courts.

They can still deny your plates. My advice would be to not pay the debt as it is stat barred and they can't seek a judgment.

Keep an eye on your credit report. After six years of inactivity a debt can't be displayed. This debt should not be there. If a collection agency tries to re-age the debt by claiming that you made a recent payment -- fight it. Write a letter to the collection agency, start an investigation at Equifax and Trans-Union, and file a complaint with Consumer Affairs.

The plate renewal is impossible to fix. The best solution is just to never own a car. Instead incorporate and have your corporation own the car. The same can be done with a family member or friend but I don't like to ask people for assistance.
