Here is the story. I am probation and I got arrested for a DUI 2 months ago. I have not gone to court for the DUI therefore I haven't been convicted. I did visit my PO since the arrest and did not say anything. What are the chance she will ever find out?

She will find out. For you to withhold this information from her is a violation as each month you fill out a paper and sign it stating what police contact you had. You are in violation right there.

First off you have no way of knowing that "she will find out"! So if you are going to talk out of your bum please do not respond to this.

Now.. if anyone has a answer to my question based on previous experience or something a little more tangible I would appreciate it greatly.. I was hoping to talk to excon.He seems more knowledgeable when it comes to this kind of thing.

I worked as a paralegal in criminal law firms for many years so I'm not talking out my "bum" as you put it.

And I sincerely doubt if anyone else who comes along will tell you any differently than what I did. And with that kind of an attitude I hope you serve some time in jail because if you approach your PO and/or your judge talking like that you surely will be spending time in jail.

My question to you is, how in the world do you think they won't find out?

You have a criminal record, you're on probation, just because you haven't gone before the judge for the DUI doesn't mean you won't.

Of course your PO will find out.

Have fun in jail.

The Probation Officers having nothing to do and all day to do it just for fun they like to run all the people on probation to see if there are any new arrests since they were put on probation. This is part of the job duties of a Probation Officer.

I think they get extra gold stars or smiley faces for that, but don't hold me to it.

Of course they will find out, the arrest shows up on the NCIC report that the PO can look at on you. They run this report on regular basis.

Also not telling them of the arrest is a violaton of your probation, even if you latter are found not guilty, so even if you are not convicted, they can still revolk your probation for just not telling them.

You had better get your rear in their office and report this, before they see it on the computer report.

Like I said the PO's have all day and nothing better to do...

But she won't listen to us. She wants to listen to Excon. Oh Excon where are you? Paging Excon to surgery, paging Excon to surgery!

I'd give it 80/20 in favor of the PO.

Out there in the probation world, you've got your two kinds of PO's: The young want to be cops type of PO, and the old ain't never going to be cops type PO.

The young want to be cop types are going to definitely find out. They probably run an NCIC on ALL their charges every morning before breakfast. If you've got one of those PO's, you're toast.

Then there's the old burnt out bureaucrat PO's who just want to get through the day so they can grab a six pack. If you've got one of those, you've got a better chance.

Ok - you want an answer based on previous experience? She will find out.

Its her job to find out and each time you don't tell her you are getting into more trouble.

To expand on this... you will eventually go to court and the will TELL your PO. So even if your PO does nothing, she will find out.
