    Marital home information during separation
    I am separated from my husband for 2 years with no legal documents filed. Do I have a right to half the income of our home if it were rented? He still wants to live in it. Should I ask for rent money?

    Until you actually file a petition for divorce, anything goes. If you can get him to agree to rent it, great but if he wants to live there and chooses not to pay rent, you have no legal recourse until you get an attorney, file for divorce, and get temporary ownership of the house or at least a stipulation that he must pay all bills (including a mortgage) incurred while living there. Bottomline: file for divorce and be the first to file and get an injunction for him to pay rent or move out. Be prepared and do what needs to be done.
