Questions about bank acct freeze
Hello, I've had a garnishment placed on my bank accts from an old credit card debt, I thought had been paid. Apparently, in 2004 I was served court papers - (I think an old roommate signed for them & never gave them to me) for the court date. Anyway, I did not appear in court. I really was unaware of any of this until last week when my debit card was taken at an ATM. The bank told me of the freeze on ALL of my funds.
The bank was notified 12 days ago from the court. However, I still have not received any notice of garnishment/judgement from anyone. I have borrowed the funds from elsewhere to have them available to be released for the debt (2xs what I originally owed) so this matter could be resolved immediately. However, I now learn that the bank has to hold the funds for 30 - 45 days, then the court holds them 2 weeks... ugh, will this ever end?
Questions: Do I have any grounds for dismissal since I have not properly been notified (unless you call the 04 court case notificiation)? Is it possible to negotiate w/ the credit card attorney's at this point? I am trying to refinance my home & I want to clear this up ASAP... not wait until October. Does Georgia have a 'wild card' amt that can not be claimed in a bank garnishment? Any & all advice welcome & needed. :confused:
