    California prorate rent tenant move out mid-month
    I live in California. I have a month-to-month verbal rental with my current tenant. He has given me satisfactory notice that he is moving out on February 22, 2009. He tells me I have to prorate rent based on a 30-day month. I have been told that, with a month-to-month rental agreement, I can use the actual 28 days in the month. Would you please tell me which is correct and what the California law code number is that covers this issue. Thank you! :confused:

    I am going through a similar problem now with my tenant. Did your tenant pay last month's rent on move-in day?
