    H1B Visa Tax return - Forms
    Hi,

    I am on H1B visa and I want to file my Tax for year 2008 .
    Please find my detail and suggest which form I have to fil

    Working in USA since Feb 2008 till date on H1B
    Married & wife is on H4
    I was there in usa in year 2007 on B1 for 2 months

    Please guide me...
    1. which form I have to choose
    2. Am I eligible for resident Alien status filing (Considering SPT)
    3. Do I need to Apply for ITIN for wife
    4. Any other information

    You can file resident tax return as Married Filing Jointly.

    You will get standard deduction of $10,900 and exemptions for both of you.

    You must both declare your worldwide income for 2008. If you have any foreign income, and on that income you paid taxes in the foreign country, then you can claim foreign tax credit.

    You will complete forms W7 (application for ITIN) for your spouse and attach with your tax return.
