I have been on probation for a long time. I have done everything proper met all appointments and paid all fee's. I'm presently on un supervised probation but my probation will not end until October 09. I'm 70 years old and would like to travel but can't. I'm also blind and this puts a real burden on my wife. Is there a form or a sample letter I could get to write the Judge for a early probation release.

What was the original charge?

It's a long story, but domestic violence. I was given the wrong medication and had a violent reaction. Scared my daughter and she called the police. My lawyer was not much help.

On a domestic violence charge - at least in NYS - medication or no medication, you are not going to get off probation early.

There was no physical attack, what got me in trouble was I fired a gun 2 times in the house.

And were found guilty of domestic violence. I think firing a gun inside a house where there are other people IS domestic violence. Of course, that's only my opinion.

My ex was a fairly violent man. People who shoot guns inside houses are guilty of domestic violence, shouldn't be surprised that they are found guilty of domestic violence and should not be allowed to blame "it" on drugs/alcohol/prescription medication.

So, no, I don't think you'll get off easy or early.

I have to agree with Judy. Firing a gun inside of a house at any point in time isn't safe whatsoever and I'm sure you already know this. When were you originally put on probation?

No, you're not going to find a form or sample letter. But the FORM of your request isn't going to matter. It's the MEAT that's going to make a difference.

I know, your last attorney didn't do you any good. Ok, don't hire HIM. Hire somebody else. Because no matter what you say in your letter to the judge, the prosecutor is going to be saying the opposite, and it's going to sound like these people.

So, if you're going to have ANY chance, I think you're going to need a lawyer...

If you want to chance it on your own, just write a letter and tell the judge exactly what you told us. Ask the judge to consider your letter to be a motion. Send a copy to the prosecutor. Send them certified, return receipt requested.

But, you're a short timer. I don't care how long you've been on probation. I only care how much time you've got left.

And I told you that people who shoot guns in the house are abusers. If you get off probation, travel around and continue to take ANY medication, please stay out of NYS.

Sorry I offended you. I now longer care about guns and own none as it should be. I still take medication for other things but mostly for old age pain. I have never in my 70 years been arrested for anything until about 3years ago when I did this. All I asked for was some advice on how to write a letter nothing more nothing less.

What about sexual dilinquency with a minor? Misteamenor I'm done with everything I need to do 5 years of probation already did 2 years

You're rude. Nothing more, nothing less. You obviously have no form of empathy either. So you dealt with a man who was violent toward you, that doesn't mean that this man is a bad man. Mistakes and accidents happen and you have no clue what medication he was on. Therefore, you have no way of knowing what the side effects of that medication could be and all people are affected differently physically and mentally. Just thought I should let you know a little about yourself since you were so eager to judge someone else's mistakes.
Mr. Branford, I have been unable to find a sample letter to the judge to help you in this instance, but I do recommend some legal assistance if your inquiry is serious. As said before though, you simply write a letter to the judge who convicted you stating who you are, your charges, how long you served, how you have been rehabilitated and why you feel it is necessary for you to be released from your probation early. I wish you the best of luck and try to ignore ignorance from others who only know the outskirts of your situation. I don't feel as though you should be apologizing for offending anyone by simply asking a question, because she was the one being offensive, not yourself. I hope you find what you are able to find what you are looking for.

Speaking of ignorance this was asked in February 2009. I'm sure the OP has figured it out by now.

One again - amazed that someone would take the time to seek out AMHD, find one thread, file an answer blasting someone on a thread that's over 3 years old - and disappear!

I'd like to hear more about your statement that drug-induced accident, violence and mistakes should be overlooked or forgiven. "All" this person in this long-ago post did was shoot a weapon in a house where there were other people - twice.

Good you believed that he should be excused for this "mistake" (and thank goodness he didn't kill someone) because very obviously the Judge didn't.

And you are right - I probably only know the "outskirts" of this situation.

I actually sought out nothing... I was researching and came across it not paying attention to when it was posted because actually that part didn't matter to me. I definitely didn't just disappear, but I didn't stick around on the page just to wait and see if someone would reply either. I also never said that they should be overlooked, forgiven is a different story, but not overlooked. I never downplayed the incident or said he should not have been convicted. This is a LEGAL thread, not a moral thread. The question was what the LEGAL circumstances were. That's what I answered.

I did respond LEGALLY to his post, I also responded to your NON LEGAL response. YOUR response said what SHOULD and SHOULD NOT be done because of how you FELT about the situation and your prior experience with an abusive man... not about how he could LEGALLY go about writing his letter. Regardless of what you suggest, it is a PUBLIC forum so I am able to comment when and where and how I please. :)

In the meantime - if the person who posted this in 2009 comes back, I'm sure he'll acknowledge and appreciate your "advice" - which is "I can't find a letter but ..."

You obviously are not in NY and obviously are not involved in the legal system in any way. In NY shooting a firearm inside a residence twice when there are other people present is frowned upon. In fact, the "the medication made me do it" defense didn't work in this instance and works in very few cases.

I'm waiting to hear the "outskirts" of this situation which apparently you understood and I did not.

What were you researching when you came upon this thread? Same queston has been asked many, many times - how did you end up on a 2009 thread?
