    Landlord Taking Possession
    I was in a lease for a mobile home that was suppose to last for 5 years. I only lived there for 6 months before bills got to be too much and I started the process for filing bankruptcy. My attorney advised me to find a new place to live as my lease was going to go into it. I found a new place and moved out. While I had a few personal items still left in the house my landlord took it upon herself to take possession of the trailer without giving me any sort of eviction notice. She also took the utilitys out of my name and put them in hers. I am just wondering if this is right? Granted I did not pay rent for 2 months but I always thought they had to serve an eviction notice before they could do that. Please help me. Thank you

    Take her to Small Claims Court for the value of your property. She will then countersue for her lost rent and any damages. As long as your belongings were there she can claim you lived there and charge you rent. She is not a storage facility.

    The Court will decide on the award.
