    Trying to be done and get home
    I have been separated from my husband for going on 6 years. He is in another relationship as am I. The only reason I have not gotten a divorce is because I have been raising our son with no financial help from him, making the extra money I would need for a divorce hard to come by. He does see our son regularly.
    I would like to finally end this and get the finalized divorce (he would sign the paperwork no problem). However, I would like to move back home to Ohio where my family is. I would have help and support there. I am going to school full time and I also have the opportunity for a job up in Ohio. (We currently reside in VA) I am guessing that he will not be thrilled about this, but he also does not financially support his son. Is this something I can do once the divorce is final? Is there specific paperwork that I would have to do? If anyone can help I would greatly appreciate it. I would like to be home where I have some support and help.

    I'm not savvy in the laws regarding divorce etc DS but I'm sure he would be obligated to provide financial support to raise your son.

    Hopefully someone with more knowledge in this area will come along and assist you more.

    First by filing for divorce your husband would be obligated to support his son, which would have been helping your financial situation for the last six years.

    Second you have to have permission from the court to remove the child from the state. Divorces, even uncontested, take time and if you are looking to move anytime soon, it would be very difficult.

    Beyond the divorce, has there been a child custody order in court, is there a parenting plan developed and submitted to the court. Is there a child support order from the court. A divorce is just a small amount of it.

    He will be awarded visit rights, and be ordered to pay a certain amount of child support.
    After that depending on the agreement, you will have to get his permission to move away to a distant that woul stop him from seeing the child.
    Him not paying suport, you needed a court order first and then go to court to enforce it
