If the divorce decree says he can claim them, then he can until they are finished with school

What does your current support agreement say?

Until 18, but that was before we knew he was handicapped I was just wondering he has nothing to with them anyway

If the original support order was made before the disability as diagnosed, then you certainly can go back and ask for a modification.

Thank you one more thing wouldn't I have to sign a form with the IRS for him to caim them or the decree stands for it self?

You can of course go and ask for that to be modified, and also check to see if the support is correct for his current earnings since 85 a week would normally be about a min wage employee

That's is what I said lol I was mainly wondering I know the decree stands with the IRS but was wondering if I took him to court on that if the judge would see he had nothing to do with these children and claimed them I really thought he would be a dad but all they were to him was a tax deduction and it is a shame someone would be that way I don't know seems to be a no win situation
