    He wants to know if he's the dad, she won't give dna test
    My boyfriend recently was informed that he may be the father to a one year old girl. The mother says that she had a different man sign the birth certificate but believes he is the dad. He then told her that if the girl was his that he wanted to be a part of her life and have visitation. She told him she did not want anything from him and wanted to be left alone, she doesn't want to put her daughter through that. My boyfriend believes that he is in fact the dad, however, she will not do a DNA test to prove to him that he isn't. We informed her that if she did not do the DNA test willingly, we would be hiring an attoney. She then told him that he would have to prove that they were ever together in the first place. What kind of rights does he have in this situation and what kind of evidence do we need to prove that she told him he may be the dad?

    So if he wants the test and wants to be part of the child's life, why is he wasting time "talking" to the mother and not filing a motion in court to ask for a DNA test and then visits if he is the father.
    Nothing will happen until he does that. And if he waits too long in some US states he may lose that right

    I guess I needed to be a little more clear. My apologies. This happened on Feb 4 while he was in Missouri doing clean up after the ice storm. He has not talked to the girl in almost 2 years and was hoping she would do this willingly. He got home yesterday morning from Missouri and met with her yesterday evening. She is telling him he can not have the dna test. We advised her yesterday after she told him no that we would be contacting the attorney Monday morning. I guess I need to know what kind of evidence we need to get the court order, she told him she would deny ever telling him this information. He has saved all the texts she has sent him over the past couple days along with a picture of the baby she sent him. What do we need for proof to take with us to the lawyer?

    Evidence that he dated her at the time she conceived and that she claimed he might be the father.
