Hi my name is Tosha and I have a 9 month old daughter. Her bio- father has been out of the picture for over six months. He is not on her birth certificate. My fiancée wants to adopt her, but we don't want her bio- father to try to come back into the picture out of spite to me. What can I do? Can my fiancée adopt my daughter without the bio- father signing over his rights? Could he come back into her life after she is adopted?

1. You MUST have the bio father's rights terminated, either voluntarily or by the state. Good luck getting them terminated involuntarily, though--you usually have to prove abuse for that to happen.

2. Most states require that you be MARRIED in order for a spouse to adopt. Being your boyfriend is just simply NOT going to be good enough.
