    Can a mother who left for many years come back and get 50/50 custody?
    My boyfriend has had full physical custody for 2 years of his 4 year old daughter.
    Now before that he had 50/50 custody for one year , the mother of the child has been out the child's life since about the time she was 8 months she has never shown any interest in being involved in this child's life no visits no phone calls etc!
    So its been my boyfried (with some help of the child's maternal grandmother)that has raised her for most of the child's life now
    Now years later the mother of the child has filed for 50/50 custody. He has hired a lawyer but we are concerned that the court will grant her half custody of the child even though we know she is filing just so she does not pay child support(which he filed just 4 months ago).
    Do you think 50/50 will be awarded to her?

    She can file all she wants but it doesn't sound likely. If she has been MIA for 2 years the child at that age doesn't know who mommy is. So at best there would be steps taken before a 50 / 50 could occur. That's my opinion and what happens in court no one can tell you for sure. When a parent seeks to reunite with a child normally the courts don't stand in the way ( they favor it ) but its graduated. Like supervised visits to start with for 6 months to a year then possibly overnights etc. In the end could she get 50 / 50 yes. Is it going to happen at this hearing ? In my opinion its not likely.
