    Salary versuses hourly
I started as an hourly worker in construction. I was given verbal advancment Twice which caused my pay to raise fairly well in both incidents. My pay never Exceeded 60,000 a year. I being a Dedicated employee always gave extra time to the sites I was @. I was recently told that all the doctor appt. that I took were deducted from my biweekly pay. I was laid off with no severence or anything to say gracias. All my diaries show my twelve hour days For three years. Should I be compensated for this?? I was green willing to do what it takes and never understood or really asked HR what the difference or whether it mattered. Please help if you understand.

    Hello c:

If you were on salary, and they deducted time from your check, I'd sue them for the money in small claims court.

No, you shouldn't be compensated for your extra hours, because you weren't working hourly.

If you were hourly you had a obligation to report any time worked and/or only work those times scheduled for you to work, If you went in, without permission and worked hourly they have no obligation to pay you.

If on the other hand you were salary, then you still don't get any additional pay, but they are not to deduct missed days either.

I was never told I was salary until I was told I needed to be there @ all times to oversee things. Im not bitter just curios. Logging my time was something I had always done.

Also I had always had to fill out A time card every two weeks the entire 5 years I was there. And this never changed .I also always deducted my early days and so did they.
