    About H1b tax
Hi, I came from china as foreign student 5 years ago. I changed my visa from f1 to H1b in 2007, I claim the tax treat deduction under article 20 for about 5000 last year. To filing 2008 tax, can I still claim this tax treat for 2008. Or if there is any tax benefit for H1B visa

    Jack Li:

Under an exception to the Savings Clause in the China-U.S. Tax Treaty, you can still claim the $5,000 treaty exemption even though you converted to the H-1B visa by entering the $5,000 as a negative number on Line #21 and noted that it is the treaty exemption under the U.S.-China Tax Treaty.
