    Car issues
    My divorce was just finalized. Both of the vehicles were in my ex husband name. I was awarded his car and he took my truck. After the finalizing of the divorce I called the bank to set the payments up automatically from ym checking account. They informed me of two things; one, I am no where on the account and two, that the vehicle was almost three months behind! I told my ex husband that he can have his car back and I will make do for right now. He then told me "Your stuck with the car B^%&, get over it!" I refuse to refinance a vehicle that is so far behind. Not to meantion I have already paid off all of our mutual loans by myself. Do I have to keep the car?

They informed me of two things; one, I am no where on the account so I need his permission to do anything and two, that the vehicle was almost three months behind (I had no idea)! I told my ex husband that he can have his car back and I will make do for right now. He then told me "Your stuck with the car B^%&, get over it!" I refuse to refinance a vehicle that is so far behind... my credit isn't that great either. Not to meantion I have already paid off all of our mutual loans by myself. Do I have to keep the car?


    I am just worried. I have never been in trouble and don't want to start now.

    Keep the car and sue him for contempt of court. They can make him pay the late payments because he's not suppose to create new encumberances during the proceedings. Check your court documents and ask your lawyer to be sure. See how much the payoff is and try to get a loan either through them or a finance company.

    I would say to hell with it. It's in his name, let it get repo'd.

    What trouble, it is in his name, if your name is not on the loan, it just goes against him.

    But if you want to keep it, you force him to sign a POA to deal with the auto ( court should have forced him to give you one, what was your attorney doing? ) and/or send them a copy of the court order giving you the auto.

    But you will need a POA so that latter you can do the title into your name, you don't have to refi if you can just catch this loan up

    You say that you were "awarded his car". Most awards will also state which party is to pay the installments, past and future. What does your divorce say about the debt on the car?
