Hello, I currently rent an apartment with my wife(is a house but we are on first floor where another tenant is on second floor) and just recently we had one of our radiator pipes burst and flood out the kitchen wich then resulted in all of our pipes freezing and house being incredibly cold. So they fixed the problem 2 days later. A week from the day the repair was made he sends me a bill... Am I responsible for this repair? It seems he is trying to blame me saying that there was no oil in my tank wich there was at the time. Heater was running all night non-stop, wich was evident seeing the 3ft of water in the kitchen. Any advice would be appreciated.

If you have renters insurance send them the bill and let them dispute it with the landlord as being for their account.

You may be resposible to do your best to stop any damage from occurring (if there was something you could have don't to prevent the damage).

Is there anything in your lease about what happens in the event of damages and is the cause of the burst pipe known?

No my lease has nothing in it about me being responsible for any major damage. I had nothing to do with the pipe bursting. It happened to a new radiator that he had put in last year. (kitchen never had radiator)

Are you responsible for the oil deliveries? If so, contact your oil company to testify that there was oil in the tank. With that proof, you tell the landlord that this incident was not your fault and you aren't responsible for the repair.

Well, flooding and the pump and the heater burner going, issue if one will happen without the other.

But OK was the oil tank out of oil ?
Do you order and pay for the oil in the tank ? But this is a hard issue, if I did not keep the heat on in my apartment, and it freezes, I can be held liable for freezing pipes.

So what caused the pipe to burst ? Did it freeze ?
