    W2 - Marital status SINGLE
    Hi all,

    On my W2, marital status is SINGLE, but I recently married. But my spouse is not currently in USA. Should I file as married or single ?

    Your filing status is based on your marital status on December 31, 2008. The IRS doesn't care where your wife lives.

    You may want to consider updating your W4 information.

    Your choice is to file Married Filing Jointly or Married Filing Separately IF you were married on 31 December 2008.

    The problem with filing jointly is getting your spouse's signature on the tax return. If mailed, the signature MUST BE AN ORIGINAL SIGNATURE (fax or scanned are NOT acceptable).

    If you file electronically, then a faxed or scanned signature on the Form 8879 IS okay.
