    Unmarried and want to change my sons last name to fathers?
    My boyfirend couldn't make it to the hospital when I was giving birth and he doesn't have his last name and its been five years now and we want to chage the babies last name to his dads last name. What can I do, since we are not married we just live together? We do plan to get married but economy is not that great so we wasn't to wait awhile.

    Regardless of whether your boyfriend was present at the child's birth, a hospital doesn't automatically assign a last name to the child; that's the parents' decision.

    You can file in court to have the child's last name legally changed to your boyfriend's last name. Has there been paternity testing done so that your boyfriend is legally established as the child's father?
