    Status is H1B in 2008 but no earnings throughout and no W2
    Hi Experts,

    Would appreciate your help in dealing with this issue.

    My wife was on H1 B status throughout 2008 (i.e Passport has a H1B status).
    However,due to the bad economy she was unable to get a job throughout 2008. She therefore has no paystubs and employer has not given her any W2.

    Can I file her as my dependent because her earning for year 2008 was 0$?
    Would it adversely affect her H1B status or cause any issues with any further stamping.

    Let me know your thoughts on how to get through this situation.

    You can file joint return as residents even your wife had zero income. You will both get standard deduction and exemptions.

    Hi Mukta,
    If I file as dependent , it will not have any adverse affect on my wife's H1 right in future?
    That's my major concern

    You are NOT her dependent; you are her co-filer.

    It will NO adverse effect on her H-1 visa in the future.
