    Should I get my deposit back?
    My husband and I rented a house we moved out in October. We did the final walk through on October 30, 2008, I gave the rental company my fowarding address and both contact numbers. The lady told me we would receive paperwork within 30 days of what we would get back or owe. I have not received any paper work or phone calls. Should we get our deposit back since we never received any paperwork. In some states you receive it back, it is the same in North Carolina? Thanks...

    Under NC law the landlord has 30 days to return the deposit or an accounting of how it was used. If the landlord fails to do so, the tenant can file suit in Small Claims court for the return of the deposit plus any damages caused by the failture to return it, including attorney fees.

    So yes, you can now merely sue for the full amount, since they did not provide you any deductions within the time frame. You will have to file in the local small claims where the rental is located
