My husband and I have separated four times in one year. When we separated the second time, I asked him to pay me child support voluntarily and he agreed. I receive child support from him through the NC Child support system, we have been back together for two months. I do not want to drop the child support because I am not sure our marriage is going to work. We both agree that if we remain together for more than a year with counseling then I will drop the child support. Is it illegal for him to pay child support and we are together?

Im at a loss here because before a state agency can get involved then there has to be court orders in effect. Is there a court order for child support with grounds for a baseline of support ?

My ex and I went through this as well. All of the money ends up in the same home, he gets credit for paying and if things do not work out then you don't have to start the hassle and paperwork again, which sometimes can take months to become effective.
