    Recovery Rebate Credit
    Hi,

I (H1 with SSN) arrived in US in March 2008, for the first time on H4 without SSN.
Am I eligible for Recovery Rebate Credit?
IRS is asking for SSN for my wife, to get this credit..
First time coming to US will not effect to claim for Recovery Rebate Credit?

    Thanks,
    Sumit

    Sumit:

If your wife has an ITIN, and you file jointly with her, you will NOT be eligible for the Recovery Rebate.

To get the recovery rebate, you must file Married Filing Separately, apply for the recovery rebate, get your refund, then (and only then) amend the return using Form 1040X to file jointly with your wife.

This process is perfectly legal (so says the IRS).

    Hi,

Can you/ some one let me know what the max refund I can get after filling my fed + state return by seeing my docs, before charging me, as e-file websites do?

    Regards,
    Sumit

If you file as married filing separately, you can not file a resident tax return. You are dual status and hence not eligible for the recovery rebate.

Is that means I cannot claim for 2008 recovery rebate credit by any mean?
What if RRC is declared for 2009? Can I claim in my 2010 return, as per current rules?

Perhaps; that process has not yet been determined.
