    F1 to F2 Status Change Denied
    I filed my status change on my OPT CAP GAP. My OPT expired on 08/31/2008. My H1B has been approved and it was going to start on 10/01/2008. I filed change of status from F1 to F2 on 09/26/2008 as a dependent of my husband. On 01/27/2009 I found that my status change request has been denied. Is there any way I could file it again? I appreciate any suggestion please.

    What happened to your H-1B?

    My H1B was through one consulting company, they could not find job for me. They keep on saying that if there is not job then they would terminate my h1b. Therefore I decided to change my status before actual H1B starts. I guess they terminated my H1B sometime in December 2008.

    You are already out of status so there is no fix to this. Regarding your H-1B, you can sue your employer. When you are selected and H-1B is approved means you have a job waiting, not to seek for job, you must start working by October. Contact an attorney ASAP...

    Does it mean I am illegal now. I did not receive denial letter yet. Could I wait to receive the letter and leave the country?
