    Extension for h4 visa
    Hi

    I have an H1B visa and my wife is on a dependent h4 visa. My visa expired last year, 30th sept 08, and my company renewed it. I did include my wife's name and information on that primary form but the company didn't file any separate forms for her. I understand that I was supposed to file an I-539 for her, apply for a visa extension. I would like to get some advice on how do I approach this matter.

    I have filed for my green card and we are waiting for at the second stage right now. We both have our EAD cards valid until August 2010 and my h1B is approved till 2011.

    To renew H-4, she needs to do exactly the same procedures as when she first applied for H-4. I-539 is used for changing status from one non-immigrant status to another... it means you change status, but not given a visa. To obtain a visa, you must apply to US consulate in your country.
