My daughter is on a lease in Florida, She has recently invited her ex husband to live with her the past couple of months to help out with expenses. He is not on the lease. They recently had a domestic disupte in the apt. He pressed charges, sent her to jail for spousal abuse. He has since taken up residence in her apartment and will not leave. Can she evict him on the grounds that he is not on the lease?

Yes and no. Since he's not on the lease, she is his landlord. As such she can terminate his tenancy with one month's notice. She needs to send him a notice that she is terminating his tenancy as of the end of February. If he does not vacate at that time, she will need to file for an eviction order in the local housing court. Eventually she will get an eviction order and get a sherrif to physically remove him.

She has to continue to pey the rent during this time and she should inform her landlord of the situation.
