    Earned Income Credit
    WE have 4 kids together(all 4 are ours together) have never been married. I am head of household and claim the kids as dependents. Earned Income Credit only lets me use 2 of the kids can he use the other 2 without using them as dependants

    If you live in the same house, only ONE of you can be Head of Household; the other must file as SINGLE.

    However, if you are both the biological parents of all four children, then you can pick as to who claims which child. Any child you claim will be your dependent provided you can show that you provided over half of his/her total support.

    Further, you need to check the local "common law marriage" statute for your state. It is possible that the state considers you married, in which case, the IRS will also consider you married.
