    Hi My name is Jay...

    I have been given the run around concerning my taxes and my wife. Basically I just have a few questions if someone can PLEASE! Help me!

    Q1) I am a US Citizen and my wife is currently a Chinese citizen in China and will have her visa soon so she may enter the US, Can I claim married on my taxes?

    Q2) She has no income in China and is not working. Her parents support her. If I can claim her, how do I go about doing it jointly? I don't want to claim separately.

    Q3) Some tax preparers have been pretty clueless about my situation, can you advise me a good tax preparer to do the job? (I've tried H&R block, no luck :()

    Q4) Is my wife eligible for ITIN number? I was told no before, can you please elaborate more on this for me? And if she is eligible, how can I apply for a ITIN?

    CAN SOMEONE PLEASE HELP ME, I'm tired of dead end answers:(...

    1 & 2) Yes, you can file jointly with your wife and she can sign a statement that she CHOOSES to be treated as a resident alien for all of 2008. Her physical location is irrelevent in filing jointly; she could be on Mars for all the IRS cares.

    3 & 4) She can apply for an ITIN by submitting Form W-7 with a notarized photocopy of her passport stapled to the W-7, and submitting BOTH documents with your joint tax return.
