    Lawsuit? Yes or no?
    This weekend my three small children, my fiancé, brother in law, his friend and son, and well of course myself.. all decided to go to a video store to buy a few movies to watch at home. I sat in the car along my brother in laws friend and our children while my fiancé got out to get the movies and my brother in law to smoke a cancer stick... a few minutes later I see a guy runnig full speed out of the store towards my brother in law. I seen my brother law get scared and start walking very fast towards the car.. then a second man came running out towards my brother in law and he ran back to the truck and locked the door.. the man came to my back passanger window and started to pound on it very hard
    And trying to open my door. When he couldn't open the back door he tried started to pound on the front passanger window and trying to open it like a manic man... durning this time my kids are screaming there head off... and to tell the truth I wa scared I had no idea what was going on... I decided jump out the truck and get this man away fro trying to get in my truck and do harm to my kids and to myself.. he 3walks up to me very fast fling his arms like a wrestler I push him a way and tell him to leave us alone and that I have kids in the car he being to tell me he wants the guy in the truck my "brother in law" I tell him no.. And being to say he is going to call the cops that my brother in law stole something from the store.. I said call the cops cause I know he never went into the store to.. at all..
    My fiancé comes out and is like what the hell is going on cause that guy tell me to get the hell out of here or he is going to kick my.. my fiancé runs back into the store to go talk to the manager... and we left...

    You can sue if you have damages. What are your damages? If your children were badly frightened - and perhaps they were - have you taken them to a Doctor.

    Did you call the Police?

    These are important questions in evaluating a case.

    You will have a problem if you are thinking personal injury or emotional distress because he was acting - in your words - like a maniac and you jumped out of the truck to confront him.

    Who are you intending on suing? I see nothing to sue over as there were no actual damages done. The person did not harm you, your children or your vehicle.
