    3 day notice to vacate.
    What do you do when you get a 3 day notice to vacate for a foreclosure? The problem we are having is that we have 3 kids in the house and we do not have other means of shelter. What can we possibly do to get more time to get more finances together.

    The foreclosure process is far more complicated than this. What has gone on before now? This is the first notice you've received?

    Who is giving you the notice, the owner in foreclosure, or a new owner or the bank

    Has the home sold at auction and what is the actual stage of foreclosure

    Is this your first notice

    Unless this is a court order from the judge, you tell them no you can't and then they set a court date and see a judge and try and get more time

    Yes for eviction. We received the notice of sale last April of 2008, so a friend helped to stop the sale and kind a held it for another six months. I filed bankcrupty last Oct. 2008, but was not able to attend my hearing because my father passed away. The hearing was re-scheduled but didn't have any money for the lawyer. I was waiting for the bankcrupty dismissal so that I can find somebody to help me on what to do with our house. The only thing that I received was the notice to quit and giving us three days to vacate.
    We don't have any money to move my son with three kids got laid off. We don't know where else to go.

    It says on the paper, he is the lawyer of the new owner.

    The property was already sold.

    You apparently got one reprieve - from April to October.

    You've got a couple of serious problems - you didn't appear (and I appreciate that your father died); the hearing was rescheduled. Did you appear or simply not appear because you don't have an Attorney.

    As far as your bankruptcy - what is the status of that?

    It would appear there was a foreclosure as well as a sale and the new owner wants to take possession. You could contact the Attorney and ask for a few days but the owner doesn't have to give it to you.

    This is one of those posts that doesn't have a good answer. The time to do "something" was a very long time ago.
