    Hello

    A very dear friend Kursten had a heart attack and is on life support. She is and only child and parents are passed. She has a daughter that is 11yrs old. The father of the child for some odd reason believes he has some power over what will happen to Kursten. They were never married and have been completely apart for 10 yrs. The social worker at the hospital put a close friend Nicole in the power of attorney seat. Financial and medical.

    Now he has a problem with it because he wants to go home and be done. The Dr. would like to give Kursten 7 more days. He doesn't
    Because he has a child with Kurstan can he take on power to make the choice.

    Sadly this is a perfect example of why having an advance directive can be beneficial.

    Since they were not married, and he has not been involved in her life for so long, he has no say over what medical care she may or may not receive.

    Does she have any family members as all? Might go to you as a close friend, might be left to the doctors, might have someone appointed by the court if it came down to that with a fight.

    No, he has no control over your friend, none whatsoever. If he tries for POA the courts will deny it.

    However, if he is the legal father of her daughter, then it is likely that he will get custody of the child when your friend dies. Since she is a minor and your friend died intestate, it is likely he will have control over her inheritance.
