    Child support
    My ex husband is disabled and owes over $50 thousand in child support. We recently received some social security for my son but now my ex has a new child with his new spouse. Due to the birth event, support will now be split between my son and his half brother. An attorney told me I can't do anything about either since he is totally disabled. Is this true?

    I would believe the Attorney who is far more familiar with all the facts and circumstances than we are BUT one of the few things that his SS check can be garnished for IS child support, including past due child support.

    Did your Attorney suggest that you file against the father for contempt and begin to collect his unpaid support from his SS check?

    As far as ongoing support, yes, that's my understanding so would believe your Attorney is correct.

    There are other posts occasionally where a Judge has awarded the difference between what SS pays and what the State allows for the child which would mean the father would have to pay the difference.

    Do you mean will the sociail security check be lowered or the amount of child support he is suppose to be paying be lowered.
